什么是离岸法区

       一、对冲基金概况

       1、什么是对冲基金（定义和特点）

       能说出对冲基金的许多别名，如套头基金、套利基金和避险基金，但要说清对冲基金是什么并非易事。90年代以来国内出版的多种大型金融工具书，如《新国际金融辞海》（刘鸿儒主编，1994年）、《国际金融全书》（王传纶等主编，1993年），选入了“对冲（hedging）”、“基金（fund）”、“套利（arbitrage）”、“共同基金（mutual fund）”等条目，却没有“对冲基金”的条目，说明直到90年代中期，虽然对冲基金的一些相关术语早已进入，对冲基金却还闻所未闻。

       国外对对冲基金的理解也颇为混乱不一，试列举一些最新的研究文献对对冲基金的定义如下。IMF的定义是“对冲基金是私人投资组合，常离岸设立，以充分利用税收和管制的好处”。美国第一家提供对冲基金商业数据的机构Mar/Hedge的定义是 “采取奖励性的佣金(通常占15—25%)，并至少满足以下各标准中的一个：基金投资于多种资产；只做多头的基金一定利用杠杆效应；或者基金在其投资组合内运用各种套利技术。”美国另一家对冲基金研究机构HFR将对冲基金概括为：“采取私人投资合伙公司或离岸基金的形式，按业绩提取佣金、运用不同的投资策略。”著名的美国先锋对冲基金国际顾问公司VHFA的定义是 “采取私人合伙公司或有限责任公司的形式，主要投资于公开发行的证券或金融衍生品。”

       加入金融衍生工具比如期权以后会怎么样？不妨再举个例子。如果某公司股票的现价为150元，估计月底可升值至170元。传统的做法是投资该公司股票，付出150元，一旦获利20元，则利润与成本的比例为13.3%。但如果用期权，可以仅用每股5元（现股价）的保证金买入某公司本月市场价为150元的认购期权，如果月底该公司的股价升至170元，每股帐面可赚20元，减去保证金所付出的5元，净赚15元（为简便计，未算手续费），即以每股5元的成本获利15元，利润与成本的比率为300％，如果当初用150元去作期权投资，这时赚的就不是20元，而是惊人的4500元了。

       可见，如果适当地运用衍生工具，只需以较低成本就可以获取较多利润，就象物理学中的杠杆原理，在远离支点的作用点以较小的力举起十分靠近支点的重物。金融学家将之称为杠杆效应。这种情况下，假如说不是为了避险（也就是实际上不对冲），而纯粹是作市场的方向，并且运用杠杆来进行赌注，一旦做对了，当然能获暴利，不过风险也极大，一旦失手损失也呈杠杆效应放大。美国长期资本管理基金（LTCM）用自有资金22亿美元作抵押，贷款1250亿美元，其总资产1200多亿美元，它所持有的金融产品涉及的各种有价证券的市值超过一万亿美元，杠杆倍数达56.8，只要有千分之一的风险就可遭灭顶之灾。

       A、利用各国宏观的不稳定。寻找宏观经济变量偏离稳定值并当这些变量不稳定时，其资产价格以及相关的利润会剧烈波动的国家。这类基金会承担相当的风险，以期有可观的回报。
